Today, there are two types of bioclimatic pergola: freestanding and lean-to. Depending on the project you have to sublimate your terrace, it is important to be well informed about the obligations and authorisations to be respected.

Near a swimming pool or in your garden, a self-supporting bioclimatic pergola can be installed anywhere on your property as it has 4 legs fixed in the ground.
This type of pergola does not necessarily require planning permission if it covers a surface area of less than 5m² and you are not located in a protected area.



However, two types of declaration are possible when the bioclimatic pergola exceeds 5m²:



- For a surface area of between 5m² and 20m², you need to make a prior declaration of works to your local council - For a surface area of more than 20m², you need to apply for planning permission at the local council

Attached to the wall of your house or flat, the lean-to bioclimatic pergola entails a modification of the façade of your property. The regulations are more or less the same as for the freestanding pergola. If the pergola covers less than 5m² and is not located in a protected area, no planning permission is required.



When the 5m² threshold is exceeded, several things may be required:



- For a surface area of between 5m² and 20m², you must make a prior declaration of works to your local council. Once accepted, you will receive an authorisation or a town planning certificate
- For a surface area of more than 20m², you need to apply for planning permission at the town hall


What are the steps to follow to declare work on a pergola?

To establish a preliminary declaration for the construction of your bioclimatic pergola, the steps are simple. All you have to do is fill in the Cerfa 13703 form that you can find on the Service Public website or at your local town hall. Within 30 days, you will receive a reply so that you can start the installation procedure for your pergola.


If you need to put together a building permit application file, you will need to fill in the Cerfa 13406*07 form, which can be found at the town hall or on the Public Service website, and attach various supporting documents.
As soon as the documents have been completed, you must submit your application to the town hall, which will reply within two months.
